1. About these terms
These terms are an agreement between you, the guide, and Fleek Photos Limited, which runs GuideGallery. They cover the GuideGallery app and website. By creating an account you agree to them. Our Privacy policy explains how we handle personal data.
2. What GuideGallery does
In short: a free photo gallery for your guests, and a way for them to tip you for the tour.
GuideGallery lets you share a free photo gallery with the guests on a tour you have run in person, and lets those guests choose to tip you for that tour. Every guest can view and download the photos at no cost, whether or not they tip.
GuideGallery is not a place to sell photos or any other goods or digital products. Tips must never be presented as a price for photos or for anything else.
3. Who can use it
You must be 18 or older, work as a tour guide, and live in a country where we offer guide accounts (currently the UK and the US). The details you give us, and our payment partner, must be accurate and kept up to date.
4. Tips and payments
In short: tips go straight to your own payment account. We take 0% for 30 days, then 5%.
Tips are voluntary gratuities from guests for a tour you delivered. They are processed by our payment partner and paid into your own payment account, which you set up in the app. GuideGallery does not hold your money.
We charge no platform fee on tips for your first 30 days, then 5% of each tip. Card processing fees set by our payment provider also come out of each tip. Guests are never charged more than the tip they choose. How refunds and disputes are handled is set out in Tips, refunds and disputes.
5. Photos, consent and children
Only share photos taken on the tour, of guests who were happy to be photographed. If a guest asks for a photo to be removed, it is hidden straight away; please keep it hidden. Take extra care with photos of children, and never restore one a parent or guardian has asked to remove.
Tell guests you're taking photos to share through a private gallery link, and get any consent the law where you work requires. Only photograph under-18s when a parent or guardian is on the tour and agrees. Share each gallery link only with the people on that tour.
For the photos you upload, you are the controller of any personal data they contain, and we process it on your behalf as your processor: only to run GuideGallery as these terms describe, kept confidential and secure, using the providers listed in our Privacy policy, and deleted with the gallery. We help you respond to requests from people in your photos, and tell you without undue delay about any breach that affects your galleries. You keep ownership of your photos and give us a limited licence to store, show and deliver them so the service works.
6. Acceptable use
Everything you put in a gallery or on your guide page must follow our Acceptable use rules. In particular, never offer anything for sale, never present a tip as a price or a requirement, and never upload anything sexual or anything that could put a child at risk.
We have zero tolerance for child sexual abuse material. If we find or are told about it, we remove it, close the account, keep the evidence and report it to the authorities, such as the National Crime Agency or the Internet Watch Foundation in the UK, or NCMEC in the US.
7. Storage and deletion
Galleries and their photos are deleted 7 days after the tour. Photos a guest asks to remove are hidden at once and deleted with the gallery. Keep your originals on your phone: we don't keep a copy once a gallery is deleted.
8. Tax
You run your own business: you are not our employee, worker or agent, and we don't control your tours. You are responsible for the tax on the tips you receive.
Where the law requires, our payment provider or we report the tips you receive to tax authorities, for example on Form 1099-K in the US, and may ask for your taxpayer details to do so. You agree to receive tax documents electronically.
9. Ending your account
You can delete your account at any time in the app: here's how. We may suspend or close an account, or turn off tips, if these terms or the Acceptable use rules are broken, if we suspect fraud, or if the law requires it. We'll tell you why unless the law or someone's safety prevents us. Some records, such as tip and tax records, are kept after an account closes for as long as the law requires.
10. Liability
GuideGallery is provided as it is, and we can't promise it will always be available or free of errors. To the extent the law allows, we are not liable for photos or anything else that guides upload or share (or any missing consent for them), for lost tips, profits, business or data, or for indirect loss. Our total liability to you in any 12 months is limited to the greater of the fees you paid us in that time and £100.
You are responsible for the photos you take and share and for how you run your tours, and you agree to cover us for claims that arise from them, or from tax you owe on your tips. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit.
11. Disputes
If something goes wrong, please contact us first. These terms are governed by the law of England and Wales, and disputes go to its courts, unless the law where you live gives you the right to use your local law or courts. Nothing here removes rights you have that can't be waived. Where the law allows, disputes are resolved individually, not as part of a class action.
12. Changes and contact
We'll tell you about changes to these terms by email or in the app at least 15 days before they take effect, unless a change is needed sooner for legal, security or safety reasons. If you don't agree, you can close your account before then. Questions about these terms: support@guidegallery.app.
